On conduct "parliament elections" in fictitious "Republic of Nagorny Karabakh" on June 19,2005 - June 18, 2005

STATEMENT
Of the Central Election Commission of the Republic of Azerbaijan

With the help of the third power, Armenia occupied 20 percent of territories of Azerbaijan, led one million Azerbaijanis to ethnic cleansing and drove them to an exile from those lands as well as from Armenia, their historical motherland. As the result of terrible violence children, women and aged people were killed, thousands of people were captivated and taken as hostages, Khojaly Genocide was perpetrated.

Big part of the territory of the Republic of Azerbaijan being under the occupation of the armed forces of Armenia, the existence of the separatist regime in the occupied upper part of Karabakh and conduct of ethnic cleansing by the political leadership of Armenia was recognized by the Parliamentary Assembly of the Council of Europe (Resolution N 1416/2004)

Armenia is zealous to legalize the occupation, displays carelessness on the generally-accepted principles and norms of the International Law, perplexes international community and democratic world from the fulfillment of present UN Security Council resolutions to free territories.

Armenia Violating main rights and freedoms of citizens of the Republic of Azerbaijan in the territory of Azerbaijan, Armenia created fictitious body called "Nagorny Karabakh” and repeatedly tried to show scene of "elections”. And now the invaders are intending again to conduct "parliamentary elections” on June 19, 2005. A new election game on occupied territories of Azerbaijan absolutely contradicts the norms of International Law, the Constitution and other Laws of the Republic of Azerbaijan. This is also an effort of political authority of Armenia to confuse the international community and world countries those now understands real essence and reasons of occupation, and impede peace negotiations.

According to the Constitution of the Republic of Azerbaijan, non of social groups, organization and individual can misappropriate the authority for implementation of government. Elections and referenda must be held in accordance with the Constitution and the Election Code of the Republic of Azerbaijan.

Bureau of the Parliamentary Assembly of the Council of Europe refused to observe "Parliamentary elections” in the fictitious body to be conducted in 2005 by the Decision on its General Meeting on June 6, 2005. Bureau fairly noted that conduct of elections in the fictitious body not recognized by countries, is illegal and contradicts the norms of the International Law.

Central Election Commission of the Republic of Azerbaijan declares the "observers” those are intending to observe the "elections”, should refrain to be ignorant to the international norms. Their actions will be considered as a rude violence against sovereignty of the Azerbaijan State.

The source of power in the Republic of Azerbaijan forms from the common, equal and straight to the law, by secret and private elections that show the will of people. Azerbaijan State guarantees freely performance of citizens will by protecting principles and norms of voting rights.

Central Election Commission of the Republic of Azerbaijan declares that elections and referenda on the occupied territories must be conduct only after the restoration of territory of Azerbaijan and in case people who lived in those territories are back to their permanent living places in accordance with the Constitution and Laws of the Republic of Azerbaijan.

Central Election Commission of the Republic of Azerbaijan considers such kinds of "elections” against the sovereignty and territorial integrity illegal, don’t recognize it, and calls the international community for that.
