Elections to the Milli Majlis – 2015

By the Order dated 28 August, 2015 of President of the Republic of Azerbaijan, the Fifth call Elections to the Milli Majlis of the Republic of Azerbaijan will be held on 1 November, 2015. After official announcement of elections, Central Election Commission approved "Calendar Plan for the basic activities and measures on the preparation and conduct of the Fifth call elections to the Milli Majlis of the Republic of Azerbaijan” and all considered projects and events were realized according to the Calendar Plan.

The significant parts of election process which are determining the exact list of voters, im-provement of regulatory and legal basis, enlightening all subjects of elections including voters, presenting and registering the candidates for duty of a deputy, enabling the oppor-tunity for agitation before elections which is based on equal conditions, organising free and unrestricted condition for activities of observers and representatives of mass media and the implementation of other duties considered by The Code of Election were treated with special attention.

Taking into consideration that 2015th year would be the next year for elections to the Milli Majlis, Central Election Commission organised large-scale projects and started to imple-ment them starting from the beginning of the year. According to The Code of Election, like on each year, the process of determination of voters’ lists was realised on current year from January to the end of May. The members of Precinct election commissions which were functioned during this period of time determined the list of voters for own precinct. Later all this data was passed to Constituency election commissions and in consequence, they checked the lists of voters determined by Precinct election commissions and analysed according to statistical indicators entered by associated organisations. In next stage CEC gathered the data base to which voters are included and checked all possible iterations and inaccuracies in the voters’ lists via special program for analysing the quantity and quality of information about voters and then presented accurate list of voters to Con.EC. One copy of the final version of voters’ accurate list was held on Con.EC and other copy was held on CEC and on the other hand, this list was posted to CEC’s official web site.

It is known that in order to acquaintance voters with list it was attached to the walls of election points and posted to official web site of CEC starting from early 2005. Each voter is enabled to check whether his/her name is among voters or not by direct access to list or using proper search engine system and is able to obtain and check personal information (name, surname, father’s name, birth date, information about own polling station and constituency). Furthermore, voters are able to get information about the address of polling station, see map of related area and get information about transportation choices leading to related area. Voters are enabled to call to hot line  number "115” or fill in the online form on official website of CEC in order to propose checking or modifying existing errors in own personal data. All this information is going to be processed again and after proper researches the modifications are made if needed. Voters are able to approach proper Con.EC in order to check own name among voters’ list.

It should be noted that checking of voters’ lists for verification have been processing not only on election year and during the limited time frame, but continuing through year by cooperating with related cooperations on daily basis (local departments of Registration and personal identification card, local registration department of acts of citizenship circumstances and other organisations which deal with the registration of citizens) and proper information about voters’ activity dynamics was operatively gathered by Con.EC and was considered in lists.

Hot line number "115” which is functioning for issues regarding to election processes in-cluding the lists of voters and electronic hot lines received 485 appeals starting from the day elections were announced till the October 15 and all appeals were responded by CEC and the necessary measures were taken. Received appeals were generally related to checking information about voters in lists of voters, making some modifications if needed, the questions about juridical issues and procedures. In case if voters could not find their names in lists, they were able to fill in electronic form posted on official web site of CEC and send it to Commission by email of structural departments and these kind of appeals were resolved by specifying with local election commissions. Other kind of questions related to elections which were received in hot lines from citizens were also responded carefully.

The spread of obligatory refugees in various regions of republic always impedes the or-ganisation of their voting and the intense workings regarding to this issue is currently continuing.

The normalisation of voters’ amount in some polling stations and constituencies, also the organisation of rational and undisturbed conditions for implementation of voters and other election subjects’ rights were realised successfully. 29 new polling stations were established over 18 election constituencies in relation to significance of organising maximum convenient condition for voters, the moderateness of local and other condition, the impossibility of election constituencies’ border violation and the requirements of The Code of Election for determining the amount of voters according to norms defined by legislation. At the same time, information about dislocation of election constituencies and polling stations, the amount of voters according to polling stations and membership of constituency and precinct election commissions were publicly shared on official web site of CEC.

Enlightenment is always one of the most significant fields for CEC. The awareness of voters and members of lower election commissions are realised by projects in various for-mats. The awareness events in 2015 were both large-scaled and covered various trends. Firstly, after the changes "about Political parties” implied to the Law of Azerbaijan Repub-lic, various projects were realised by activities of political parties’ presenting the annual financial reports to CEC. The collaborators of the Ministry of Justice, the Ministry of Eco-nomics, the Chamber of Auditors and related structural departments of CEC Secretariat which are involved to political parties’ presenting of annual financial reports participated in the seminar held on 20th of July for information exchange of related organisations in relation to financial reports of political parties and there were presentations according to various fields of the topic, also discussions and responses for the questions of interested participants.

The broader seminar dedicated to the forming, presenting, reviewing and being socialised of financial reports of political parties was held on 13th of August at CEC. The leaders and other officials of legally registered 37 former parties, the representatives of the Ministry of Justice, the Ministry of Economics, the Chamber of Auditors, furthermore, the collaborators of related structural departments of CEC Secretariat which are involved to political parties’ presenting of annual financial reports participated in the seminar. The  speeches about the requirements about financial reports of political parties, their passing to competent authorities, reviewing and being socialised, the role, right and duties of independent auditor in the forming of financial reports of political parties, the requirements about auditor’s reviews and reports, the financial documents which are the fundamental part of reports and the details of dozens of works and also the responsibility in case of violation of requirements of legislation about financial reporting were listened in the event which was screened by Mass Media, the discussions about topics were held and the questions of participants were answered.

The Order "about the approval of National Activity Program in the improvement of efficien-cy of defence of human rights and independencies in Azerbaijan Republic” dated 27 De-cember, 2011 of President of the Republic of Azerbaijan became one of the guiding doc-uments for CEC in forming and realising the projects related to awareness and according to this document, the regularly specialised trainings about election rights are held for the members of constituency and precinct election commissions. In 2015, the project consist-ing from 2 stages was implemented for the awareness of the members of constituency and precinct election commissions. In the frame of first stage, the broad deliberation for constituency election commissions’ chairmen was held on 21st of August at the administrative building of CEC. During the event, the leader persons of some supreme state bodies - the Administration of President of the Republic of Azerbaijan, Milli Majlis, the Ministry of Internal Affairs, the Ministry of Justice, the Attorney General and the Baku Court of Appellation, also the members of CEC and collaborators of Secretariat performed in front of chairmen of Con.ECs. The topics like the duties of local authorities in process of preparation and arrangement of elections and their mutual activities with election commissions, the constitutional basis of election rights and the legislation mechanisms of their implementation, the role and activity directions of justice authorities in election process, the role of prosecution authorities in defence of election rights, the role and activity directions of authorities of the Ministry of Internal Affairs in election process, complaints about appellations related to protection of election rights and the experience of dealing with them and etc. were added to education program, furthermore, the elections held on previous years and "learnt lessons” were reviewed. The participants received needed information by questioning them to speakers. Besides it, in the frame of first stage, the chairmen of constituency election commissions were separated into 4 groups and visited several constituency election commissions situated in Baku, shared experience with those election commissions and familiarised with their activities and working conditions.
 
In the second stage of project, the specialised courses about election rights were held for the members of constituency election commissions and the chairmen of precinct election commissions during 24-26 August in regions. During the three-day courses the number of listeners was changing between 40 and 60 and it enabled for representatives of lower election commissions to participate actively and receive answers for questions which are interesting for them. The representatives of CEC, the chairmen of Con.EC, local execu-tives of regions and leader persons of courts, prosecutions and police authorities gave lectures and presented presentations in the frame of courses which were aimed to improve professional preparation of the members of lower election commissions and to enhance their knowledge, ability and working habits. Generally, the specialised courses on election rights covered more than 6000 election officials and the members of lower election commissions obtained comprehensive information about elections in these courses. The flow of courses to which the representatives of international (foreign) organisations were invited was screened by Mass Media and the population was informed broadly. 

CEC held large-scaled trainings starting from 14th of August in order to improve the pro-cedure of candidates’ registration in the frame of project in which CEC co-works with Eu-ropean Union. During the events, the presentations about the requirements of law about the registration of candidates in parliamentary elections and also about various topics re-lated to the procedures of presenting and registering candidacy were presented by inter-national experts and CEC members, the detailed information was provided in trainings which were holding with visual aids, discussions were made and the questions of participations were answered. The event which was realised as large-scaled awareness project was aimed to enhance awareness of the members of Con.EC and to enlarge their knowledge, ability and working habits. The trainings were held at Baku, Shirvan, Gandja and Shaki and lasted till the 19th of August and covered the participance of 250 officials in total from lower election commissions which included two representatives from each Con.EC which were 125 over the country.  In order to aware broader audience, the video clip related to the procedure of candidates’ registration was prepared in the frame of this project.

The State Automated Information System - "Elections” information network takes an im-portant role in provision of truthfulness in the process of election day. In order to teach the computer specialists of Con.EC how to use the network and proper software program, the practical trainings were held on August, 28 at CEC. The practical information about the new network version of "Elections” Information System which will be used for transmission of data related to election day to CEC was provided to computer specialists of Con.EC in the event, also the rules were taught by visual aids and their questions were responded.

The seminars dedicated to dealing with appeals related to elections were held between 3-11 September, in the frame of project in which CEC co-works with European Union. In the event which was aimed to aware the members of expert groups of Con.EC  about how to make detailed, objective, effective and timely defined by legislation investigation of the appeals regarding to actions and decisions which are violating the voting rights of citizens and also to provide truthfulness in the process of dealing with complaints and appeals, the members of CEC, officials of European Union and the representatives of CEC Secretariat participated. During the seminars, the presentations related to dealing with the complaints and appeals belonging to issues of violation of citizens’ voting right were presented by the members of CEC and international experts, also the covered issues were comprehensively explained through visual aids and the questions of participants were responded. The seminars which started on September, 3 as large-scale awareness project were held at Shirvan, Gandja and Shaki till September, 11 and members of all expert groups being 3 persons from each Con.EC which are 125 in total participated in these seminars.

CEC together with The Ministry of Internal Affairs of the Republic of Azerbaijan organised the seminar-conferences in the frame of program of awareness of election subjects be-tween 21-30 September which were aimed to increase awareness of police about their role in the process of elections to the Milli Majlis. In the event which was dedicated to the improvement of police’s execution of duties in elections to the Milli Majlis which are deter-mined by legislation, the members of CEC, collaborators of Secretariat and responsible persons of The Ministry of Internal Affairs presented presentations. In addition, "The Memory Booklet related to the role of Police in elections to the Milli Majlis” prepared by CEC and The Ministry of Internal Affairs was presented to the participants of event.

Another awareness event related to elections to the Milli Majlis was held on October, 1 at Justice Ministry's Penitentiary Service. The representatives of CEC provided comprehen-sive information about the organisation of elections for the collaborators of that service, in the seminar-trainings related to the organisation of elections in closed enterprises, also the procedures of election day were explained through visual aids. 

The seminar-conference about the topic "The elections to the Milli Majlis of the Republic of Azerbaijan: the role and duties of Mass Media in the process of agitation before elections” was held on October, 2 at Baku by collaboration of The Administration of President of the Republic of Azerbaijan, Central Election Commission and Press Council. In the event held for chiefs of mass media acting at the Republic and other representatives, the chairman of CEC, the leading people of The Administration of President of the Republic of Azerbaijan and Press Council, also the members of CEC presented their speeches and lectures. During the seminar-conferences in which the collaborators of CEC Secretariat, the members of Press Council and the representatives of both international organisations and foreign agencies participated, lectures about the general requirements for the agitation before elections, the subjects for agitation before elections, their rights and duties, the role of mass media in the process of agitation before elections which are held by both free and charged principles were read, discussions were held and the questions of participants were responded.

One of the projects related to elections to the Milli Majlis is public auditions held between 5-16 October at Shaki, Gandja, Barda, Jalilabad and Guba by CEC and Ombudsman institution. In these events, the representative of CEC Secretariat, the leading persons of executives of related regions and law enforcement agencies, the members of Con.EC of covered areas and also the members of community participated. In the frame of aware-ness program, the preparation to elections to the Milli Majlis, realised projects, the realising of election rights and providing the election right to citizens, election legislation and regulatory and legal documents, the principles of local and international observation and other issues were explained to participants, also the questions of participants were comprehensively responded. The observers and Mass Media members were invited to the awareness events and the condition for their participation was organised.

CEC regularly realises projects for increasing the level of professionalism of members of lower election commissions. One of the traditional projects which was established on 2002 is training project which is realised by using visual aids for lower election commissions. This project was held via the small group of trainers initially. Starting from 2008, CEC prepared 2 local trainers for each election constituency together with The Venice Commission of the Council of Europe. These trainers several years have been taking an important role on the awareness of members of Precinct and Constituency Election Commissions. The 2 staged training project was prepared related to elections to the Milli Majlis in this year in order to aware lower election commissions. In the frame of first stage, "The Training for Trainers” was held by the group of Training group of CEC at Baku between 7-10 October. During this training, 250 local trainers from 125 election constituencies were comprehensively informed with the process of voting in elections, exception situations, counting of votes, filling in the protocols and other election day procedures, and were acquainted with the situations which can happen in election day during the practical trainings. Furthermore, the experiences obtained in trainings held for previous elections were discussed and participants received advices. 

In the second stage of project to which the members of Precinct and Constituency Election Commissions were involved, the Training group of CEC prepared special auxiliary slides with all useful information for the training of members of lower election commissions and presented them to local training groups. The second stage of trainings of lower election commissions started from October, 12 and according to the schedule presented by the Training group of CEC, they are held with the visual aids for small groups consisting from 35-40 people. It is considered that the process would continue for several weeks properly to the amount of polling stations. The members of lower election commissions are comprehensively informed with the election process in the frame of trainings. Besides it, in these events each CEC member receives the booklet "The Memory for Election Day”, the example of protocol for the results of voting and examples of some other documents. In total, these trainings cover more than 32000 commission members.

After the elections were defined, CEC approved "Calendar Plan for the basic activities and measures on the preparation and conduct of the Fifth call elections to the Milli Majlis of the Republic of Azerbaijan”. In order to realise basic activities and measures consequently and qualitative which are considered in election legislation, to provide the methodical aid to election subjects and to simplify the activities of election subjects in the process of election, the Calendar Plan which defines the consequence of realising of basic activities and measures for the preparation and conduct of upcoming elections, the period of time and the scope of subjects was printed and at the same time, for easy access of all election subjects it was prepared both in Azerbaijani and English and posted to the official web site of CEC. 

The attention to the awareness of candidates who want to participate in election process was increased during these elections. Consequently, in order to make the process   of candidates’ registration pass smoothly and to be ensured that candidates prepared per-fectly and presented their documents to Con.EC, CEC prepared and published "The memory booklet for the candidates to being a deputy” related to the elections to the Milli Majlis. In this memory booklet, the rules about the presentation of election documents for the nomination of candidacy to being deputy, the gathering of voters’ signatures, the registration of candidacy to being deputy and about the registration of candidate were mentioned and also the right and duties of candidates were explained. The obtaining of useful information by using this booklet legally and effectively helped to the people who wanted to nominate own candidacy for the elections to the Milli Majlis. The issues which are required to be followed and also which are prohibited by law for candidates are comprehensively explained in this booklet. The memory booklet was prepared according to the normative acts approved by The Code of Election of the Republic of Azerbaijan and CEC, posted to web site and passed to lower election commissions, political parties and other organisations which requested in order to be distributed to related faces.

In the frame of program of awareness of election subjects, in order to comprehensively inform the members of precinct election commissions with the procedures of election day, CEC published "The Memory for the Election day”. In this booklet, the role and duties of members of precinct election commissions in election day, the opening of polling station, events during voting hours, the closing of polling station, the counting of votes and filling in the final protocol about the results of voting were explained comprehensively. The Memory booklet which was prepared according to provisions of the Code of Election and  instructions, explanations and rules approved by CEC was posted on web site and also distributed for the delivery to election subjects.

The booklet "Memory for observers” was prepared and published in order to aware ob-servers related to the elections to the Milli Majlis. The principles of observation, also the rights and duties of observers were mentioned in this memory booklet. The issues which are required to be followed and also which are prohibited by law for observers are com-prehensively explained in this booklet. The memory booklet was published in Azerbaijani, English and Russian according to the normative acts approved by The Code of Election and CEC, posted to web site and passed to Con.EC, political parties and other organisa-tions which requested in order to be distributed to observers.

Voters are one of the main goals of the enlightenment program held by CEC. CEC carried out intensive election campaign with different means and cooperate with mass media in this direction for the purpose of checking name of voters in voters’ lists, voting process in connection with Elections to the Milli Majlis as well as call for elections. Hundreds of calls and information posters with 41 names were prepared and demonstrated especially in places of dense population (trade and entertainment centers, bus stations and other social places of life and objects) as well as such clips as "Hot line # 115 of Central Election Commission”, "Check your name in election list”, "Don not forget to check your name in voters’ list”, "Voters’ lists in internet” were created and submitted to voters. Along with the above-mentioned, pursuant to the requirements of the Election Code, notifications (reflecting enlightenment information such as election rules, list of documents confirming identification in election process, place and date of elections, address of polling station where voters shall vote) are published according to the number of voters in manner and term considered in legislation and then they are spread among voters.  

Creation of legal base play special importance  for establishment of democratic values in society, improvement of election experience, holding of free, fair and transparent elections. Publications of legal–methodical means of great importance for enlightenment of lower election commission members as well as other election subjects are kept at the centre of attention in Elections to the Milli Majlis. After appropriate changes were made for ensuring of professional execution of election legislation provisions, increasing and strengthening of knowledge on election law, instruction, explanation and rules adopted by CEC were published in 9 tomes and delivered to lower election commissions.

The enlightenment of society always plays great importance for CEC. From September concerning approximation of elections, CEC intensified relations with mass media. As always for the purpose of ensuring of transparency in commission work, the activity of CEC is fully open for mass media. They are beforehand informed on time and date of CEC sessions. Mass media representatives are constantly invited to CEC events and they receive necessary information. CEC carried out press conference and briefings covering all actual themes (from the day of declaring elections till October 15) for the purpose of informing the country society regarding preparation and conduction of elections, information on all projects realized in connection with elections were presented to mass media acting in Republic as well as articles were published. This month, CEC chairman carried out 9 briefings for TVs acting in our Republic and informed the society on works conducted for preparation of elections and implemented     last projects as well as answered the questions of journalists.

 478 various materials on organized events and commission sessions were published in press from the day of announcement of elections day till October 15. Additionally, 86 ex-planations of CEC chairman, Commission members, as well as Secretary’ official persons are reflected in mass media. Great attention was paid to CEC sessions, organized events and accepted documents. Explanations, articles and press releases regarding the activity of CEC were published in mass media means. As well as pursuant to the Election Code, CEC decisions and other normative-legal documents confirmed by him were published "Azerbaijan” newspaper and placed in official web site of CEC. Generally, events imple-mented by CEC were constantly covered by mass media.

Articles and interviews of CEC representatives in press papers are also one of the projects for increasing of voters’ election knowledge. Beginning from September, day of announcement of elections till this day CEC members and officials of Secretary have made speech on different topics  regarding the Elections to the Milli Majlis in enlightenment program "Nation choose” that broadcasted for audiences once in a week in ITV channel. Furthermore, 10 enlightenment articles (on different actual election-related topics) of Commission members and officials of Secretary were published in "Azerbaijan” newspaper.

Lower election commissions spoke constantly in mass media as well as chairmen of ConECs informed voters on preparation processes and works conducted in frame of their activity.

Transparency of the process plays significant role for the conduction of free and fair elec-tions. Generally, 57656 local observers have been registered to follow Elections to the Milli Majlis of the Republic of Azerbaijan in fifth call. 872 out of 2414 local observers registered by CEC for conducting observation within the whole Republic joined observation of elections by the initiative of political parties, 111 persons by bloc of political parties, 678 observers by non-governmental organizations, 276 persons by the initiative of the registered candidate, 476 persons on their own initiatives, 1 person is an observer who got special permission. Another group of local observers were accredited by the relevant Con.EC within certain constituency. The number of observers from this row reached 55242, 27179 out of them represented political parties and blocs of political parties, 1309 represented non-governmental organizations, 57 persons initiative groups of voters, 26697 persons conducted observation on their own initiative or the initiatives of the registered candidates. 

36 international organizations as well as 465 international observers representing 53 countries took part in observation process. Both local and international observers have been provided with relevant badges. Furthermore, local and international observers have been also considered to be provided with guidebooks and other necessary materials, as well as Election Code and "Guide for observers” in English and Russian languages. Before every session and all events implemented by CEC mass media representatives, international organizations and diplomatic delegates in the Republic are made aware and invited.

Practice of using web-cameras which has been applied since 2008 in election history of Azerbaijan and allows live follow the voting process via internet will also be continued in this election. During elections for ensuring the transparency in high level along with other means, technical preparation of web cameras has been ended in 1000 election precincts within the whole territory of the Republic (approximately in 20 %), except the captured territories. By considering this issue at the session, CEC will adopt the relevant decision and the list of the precincts where web-cameras had been installed is being published and placed in official web site of CEC. On voting day, via these web-cameras internet users  (within the country or abroad) are allowed to follow live and incessantly the voting process, vote count and determination of results by entering CEC web-site without registration from beginning till the end.

After the declaration of Elections to the Milli Majlis, citizens intending to take part like can-didates in the forthcoming elections applied to Con.ECs and after having submitted necessary documents, were provided with signature sheets. Registration period of candidates was commenced since the day of declaring elections and lasted till October 9. 0Prepared blank forms are provided to citizens who have intention to participate as candidates with the purpose to fill them and return to election commissions, simplify the procedure of nomination and registration of candidacy, exclusion of shortcomings in the submitted documents as well as full explanation of this procedure was presented in the enlightenment video prepared in the frame of the projects jointly with Council of Europe and in the guidebook for candidates. Constituency Election Commissions investigating submitted documents and have been made the appropriate decisions on registration of candidates. 1805 persons out of 1823 whose candidacies had been approved and who applied, issued signature sheets and collected signatures. 15 out of 572 persons who applied for candidacies were representatives of political parties, 62 representatives of bloc of political parties consisting of 7 parties, 3 representatives of initiative groups of voters, 1186 persons nominated on their own initiative. Generally, 1753 claimers issued signature sheets and only 1457 of them collected signatures and submitted signature sheets and other documents considered in the legislation to the constituency election commissions. 1246 of these claimers who had return signature sheets were registered as candidates. It was impossible to register the candidacies of some claimers due to serious law violations allowed in the submitted documents, as well as inaccuracy of the information on the sources of income or property, besides, the irregularities committed in spite of warnings, not prevented in signature sheets. Candidacies of 15 out of 278 registered candidates are nominated by political parties, 20 by bloc consisting of 7 political parties, 2 by voters’ initiative groups, 946 persons on their own initiative. Generally, there are 330 representatives of 24 political parties among registered candidates.

Central Election Commission supplied Con.ECs with special computers for making easy the process of getting information on candidates from constituencies and realizing it operatively. Thanks to this program, the information on candidates’ registration has been transmitted to the CEC on daily basis through the current election network of the State Automated Information System, located directly on the Commission’s web-site, conveyed to publicity and regularly updated.

After ending the registration process of candidates, pre-election campaign has been start-ed. This stage is one of the important phases of election competition. In the aim of fully ensuring the possibilities specified by legislation for pre-election campaign subjects to conduct their campaigns, all activities have been taken by lower election commissions and other bodies leading by Central Election Commission within their competence, pre-election campaign atmosphere has been formed basing on fair and just terms for fair, just and transparent conduct of elections within the country. CEC, lower election commissions and other related institutions in frame of their authorities for conduction campaign by pre-election subjects and providing opportunities considered in the legislation implemented all measures, created pre-election campaign atmosphere based on equal conditions in the territory of the country for conduction of free, just and transparent elections. Pursuant to the requirements of Election Code of the Republic of Azerbaijan with the help of local executive structures 128 open, 128 closed generally 256 venues have been given to use of candidates in each constituency election commission territory. By informing the Con.ECs, candidates use these places free of charge and freely held pre-election campaign meetings with their voters. Approximately 10000 boards of big sizes were installed for pre-election campaign of candidates within each election precincts and these boards were placed in places of dense population thus they can easily read information on them. The costs offered to candidates by 45 mass media which suggested airtime on paid basis for pre-election campaign have been submitted to CEC and this information has been posted on the Commission’s web-site for candidates to be familiar with and equality of principles for all candidates are always kept in attention.   

CEC puts all necessary steps forward for free, fair and transparent conduct of elections and aims to regularly inform the publicity on election process. After declaring elections CEC conducts 21 sessions till October 15 and 156 decisions were adopted at these ses-sions. The decisions adopted within a month period embodied for substance the issues on the approval of Calendar Plan for the basic activities and measures on the conduct and preparation of Elections to the Milli Majlis in the Republic of Azerbaijan on "Fifth call”, complaints off the actions (inactions) and decisions violating citizens’ election rights in Elections to the Milli Majlis, as well as, establishment of Expert Group under CEC for in-vestigating these complaints, forming working group in order to check the accuracy of the information included in signature sheets, as well as in the documents submitted by candidates, political parties, blocs of political parties and defining its composition, confirmation of format, number and preparation rules of notifications on informing voters on the place and date of the voting, submitting complaints and appeals regarding the violation of election rights to the Central Election Commission of the Republic of Azerbaijan and Constituency Election Commissions and making changes in the Instruction on their examination rules, preparation of final protocols on voting results, approval of rules for preparation of number, form and text of ballot papers, registration of the authorized representatives of 16 political parties, blocs of political parties, revocation of registration of the authorized representatives of 1 political party for the reason of its suspended participation, consideration of appeals submitted to CEC, making amendments in the compositions of some Con.ECs, and approval of session minutes by CEC.

One of the main activity aspects of Central Election Commission is cooperation with inter-national and foreign organizations. Different projects and meetings were implemented in the frame of this cooperation, possible cooperation opportunities are discussed and change of opinions is take place. Taking into account the interest of international (foreign) organizations to the elections conducted in our country, from the   beginning of the year till this day, number of meeting were held. So thus, CEC chairman held meetings on different levels with representative staff of: Observation Committee of Parliament Assembly of the European Council, OSCE/ODIHR, Speakers Group of Ministers Committee of the European Council on Democracy, Mission on valuation of OSCE/ODIHR needs, as well as he met with members of Special Committee of the European Council Parliamentary Assembly on the observation of forthcoming elections to the Milli Majlis of the Republic of Azerbaijan, ambassador extraordinary and plenipotentiary of USA in Azerbaijan and others. At the meeting, view of exchanges on Elections was held and cooperation perspectives on the fields of mutual interest were discussed. Thereafter, other CEC officials held meetings on different levels with the representatives of the international organizations.

Every year, CEC representatives take part as international observers in the composition of various international observation missions in elections held from time to time in the foreign countries. In addition, they speak in international conferences, symposiums, seminars and such kind of events, as well as they answer the questions.

At the results of the carried out monitoring, needs of constituency and precinct election commissions were defined and necessary steps for the equipping of lower election com-missions related with the preparations to the forthcoming Elections to the Milli Majlis were made. Thus, lower election commissions were supplied with necessary publication materials, ballot boxes for using in the voting day, invisible ink balloons, ultraviolet lamps, battery for them, voting booths, single-use security locks, specific bags for storing protocols, sacks for carrying documents, office equipment and other needed means. Both Constituency and Precinct Election Commissions have been made ready to the voting day.

Form and number of ballot papers are confirmed by CEC, till October 14, period of candi-dates’ registration came to an end, publication of ballot papers on election constituencies have been started and generally 5344431 ballot papers have been published on time in manner and term considered in legislation and presented to the constituency election commissions. Final protocols shall be published in accordance with the Election Code and delivered to the lower election commissions. As well as, 30 patterns of the final protocol shall be delivered to the each precinct election commissions for presenting them to the observers and other interested elections subjects.

Ensuring secrecy of voting has always been focus of attention. For the voting of the eye-sight disabled upon abiding by the principle of secret ballot, CEC has prepared special templates and submitted to PECs also in elections of this year by following its tradition formed since 2003.

The appeals and complaints have been investigated by Expert Group consisting of 9 per-sons established under Election Code and "Instruction on the rules for the submission and consideration of the appeals and complaints on the violation of election right filed to Central Election Commissions of the Republic of Azerbaijan and Constituency Election Commissions” prepared jointly with the Venice Commission of the Council of Europe and by discussing them, CEC has adopted decisions. The above-mentioned procedures stipulate comprehensive investigation of appeals.  

Beginning from the day of declaration of the elections till October 15, totally 82 appeal were submitted to CEC and in the aim of ensuring citizens election rights, these appeals were operatively discussed in the Commission session and the relevant decisions were made. The comprehensive investigation was held regarding each complaints, necessary steps were made for checking all cases by members of expert group and met with wit-nesses, as well as gave information to Commission of the received opinion and the final decision in connection with the complaint was made at the result of voting of commission members. The participation of all interested complainers in the investigation and CEC session on the relevant matter was ensured. The activity of Expert Group was open for applicants, observers and other interested persons for the ensuring of transparency in the process of examination of complaints and appeals. They were constantly informed on investigation and were invited to observe this process. During commission sessions CEC chairman always invited applicants, observers and other interested persons to participate in investigation. 

70 of the appeals (regarding registration) submitted at this level were directly connected with the registration of the candidates and during consideration of these appeals on the whole Republic from only 55 election constituencies, most of them were decided in favor of candidates and candidacies of 17 persons were registered by CEC. Comprehensive information on all these processes was posted on the web-site of CEC for informing of citizens. 3 appeals submitted to CEC and are not connected with registration were also ensured, 4 appeals were sent to the relevant constituency election commission for being investigated, 3 appeals were returned back to the applicants cause their period of submitting in accordance with legislation came to an end, 1 appeal was taken back by the applicant and for that reason its investigation was stopped, 1 appeal was not ensured being invalid.   

Network of State Automated Information System – "Elections” Information Network plays important role in ensuring transparency in Election Day process. This year, logistics and software of "Elections” State Automated Information System were renewed, improved and the relevant information base were reformed in the aim of ensuring the transparency at high level in the Elections to the Milli Majlis, specifying the list of voters, receipt of various information regarding the elections in network from lower election commissions in more operative, easy and secure way and ensuring its approach to the publicity. Operative re-ceipt of voters’ lists, work on them and their publication, as well as the improvement of the software implementing the relevant examination in the voters’ lists. Improved, special pro-gram modules give opportunity to implement the comparison and analysis of other character, as well as to liquidate technical mistakes and investigation of the resembling information, detection of the repetitions, examination of the orthographical mistakes in the voters’ list. Optical network created between CEC and Constituency Election Commissions ensures operative and easy solution of information exchange with lower election commissions. At the turn of October – several days before the elections, wide training project is considered to be held for the computer experts of the constituency election commissions with the purpose of increasing and accepting necessary knowledge and abilities, at the same time for visual learning of usage rules via the new and improved opportunities of the "Elections” State Automated Information System.  

All election-related information has been posted on the CEC web-site (www.msk.gov.az, www.cec.gov.az, www.infocenter.gov.az). Constitution and Election Code of the Republic of Azerbaijan, all instructions, rules, comments and decisions adopted by CEC are availa-ble on the web-site in Azerbaijan and English languages immediately after Commissions sessions. Information in connection with the previous elections, as well as the activity of CEC, opinions on submitted complaints and appeals made by Expert group members, as well as the relevant decisions of CEC immediately after sessions and information sheets on sessions are located in the web-site in Azerbaijan and English languages. Furthermore, dislocation of election constituencies and precincts, voters’ search system, departure of the voters to the precinct via software having special navigation character, information on candidates to deputy, composition, address, contact information of election commissions, address and maps of election precincts, voters’ lists, information on pre-election campaign, press releases as well as other information of great interest to publicity are located on the web-site of CEC. 

Within the whole election process, from time to time renewed election-related internet site of CEC with all information are at the disposal of users. Entering web-site they get various information of their interest. Furthermore, electron services on 10 directions rendered to voters by CEC are integrated in web-site of CEC and Electron government portal and presented to the usage of voters. It is necessary to note that only beginning from the day of declaration of elections till October 15, users have entered CEC web-site 756000 times. 

Reports of Central Election Commissions in Azerbaijan and English languages are posted on the web-site of commission and addressed to local and international (foreign) organizations via e-mail.
